New Owner-Built Houses and Houses Purchased from a Builder

 

Requirements:

In order for an individual to claim the HST new housing rebate, all of the following conditions must be met:

  • Personally built or hired someone to build the house;

  • Are the first individual to occupy the house since construction; and

  • Paid HST on the purchase of the land, and/or on the construction materials and services related to construction.

Federal vs. Provincial Rebate:

If the Fair Market Value at the time the house is built is less than $450,000, you can claim the HST rebate for some of the federal part of the HST you paid.

The provincial rebate is available even when the federal is not. If the FMV is above $450,000, you can apply provincially if all conditions are met.

The maximum Ontario rebate depends on whether you paid the HST on the purchase of the land. The Ontario rebate is limited to a maximum of $24,000 if HST was paid on the purchase of the land, and $16,080 if it was not.

Homes Purchased from a Builder

When you buy a house from a builder, the builder may apply for the HST New Housing Rebate on your behalf. The builder may then pay the total amount of your new housing rebate directly to you or credit the amount against the total amount payable for the house. Builders sometimes do this so that you do not have to apply to us directly and wait to receive your rebate. If you purchased a new or substantially renovated home directly from a builder and are unsure whether you have received an HST Rebate, contact us. Don’t forget, there is a two year filing deadline from the date you moved in.

Did you sell the house before anyone occupied it?

If you made an exempt sale of the house and transferred the ownership to the purchaser before you, or anyone else, occupied it, you may be eligible to claim a new housing rebate if you had originally intended that the house would be the primary place of residence for you or a relation.
